Our client passed police officers who were parked on the right shoulder. Our client was going 45 mph and lane straddling. Before officers pulled client over, client exited freeway with right side tires completely over the solid white fog line of exit lane failing to stop at the limit line/stop sign. Client was then stopped on the right shoulder of off-ramp.

Officer observed red/watery eyes, odor of alcohol, unsteady gait and slow/thick/slurred speech.

Client then failed 3 field sobriety tests and refused to blow into portable breath test machine. Client was then arrested for DUI / Drunk Driving. After arrest, client took a blood test with a result of .09. After jury trial, client was found not guilty of both driving under the influence of alcohol and driving with a .08 or greater in the blood. Client’s DMV suspension will be set-aside.
