Our client was observed driving into a DUI / Drunk Driving checkpoint, then backing out of the checkpoint blocking traffic and causing other cars to change lanes to avoid a collision. The driver side window was also tinted very dark. Client was then stopped. Officer observed watery eyes and odor of alcohol.
Client admitted drinking 1 glass of wine. Client failed 5 FST’s and blew a .085/.085 on portable breath test machine. Client was then arrested for DUI / Drunk Driving. After arrest, client had a .094/.093 blood test result. Prior to jury trial, we filed a motion to suppress (Penal Code Section 1538.5) all evidence after stopping our client. Our motion was granted. Driving under the influence of alcohol, driving with a .08 or greater in the blood and 3 more traffic violations were all dismissed.
